Wedding Photography Terms and Conditions

LMB Photography reserves the right to:
Change or remove any contents from the site without notice. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Booking Fee:
The Booking fee secures the time and services of the Photographer for the wedding and is non-refundable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Cancellation less than 12 weeks before the wedding will result in the payment of 60% of the total agreed cost. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time. If the photographer is unavailable on the new date, the booking fee will not be refunded.

Payments:
Following payment of the booking fee, the remaiing balance for the agreed amount must be paid in full, no later than 7 days prior to the wedding date. Payment for additional images is to be made when they are ordered.

Exclusivity:
The CLIENT understands that no other professional photographer will be hired to cover the same event. This does not include a videographer. Family and Guests are welcomed to take photographs throughout the day, on the understanding that the CLIENT gives full attention to the photographer when required, to ensure the very best coverage of your day.

Display:
The Photographer/s may display any photographs included in this contract in his/her, website, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows. Every effort will be made to make the client aware if and when this happens.

Images:
All image sizes are nominal. The Photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibers. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.

Image Manipulation:
Retouching, digital manipulation and artist finishing is available to the client for free on some selected amount of photographs, in colour, black and white and sepia, together with some soft edge photographs. This is at the discretion of LMB Photography.

Delivery:
Your photographs shall be available to view online within 12 weeks of your wedding. You shall receive a DVD with the full size edited images, for your use only. This will include reproduction rights, allowing you to share digital files, and produce reprints, for personal use only. Commercial use of any images captured by LMB Photography, shall attract a further cost, and may only be used with express prior consent. It is the responsibility of the CLIENT to ensure that the image selection is made and submitted to LMB Photography, within 12 months of the wedding date. Failure to meet this deadline may result in LMB Photography not being able to produce an album as per original arrangement. If it is still possible, there will be extra cost implications to the CLIENT.

Reorders:
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

Copyright:
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988.

License:
The Photographer/s shall be granted artistic license in relation to the poses photographed and the locations used. The Photographers judgment regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

Force Majeure or Act of God:
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

Attendance:
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.? LMB Photography reserves the right to use an assistant on the day, this is at no further cost to the CLIENT, any assistant used is of good photographic ability, polite, smart and will not interfere with your wedding day. LMB Photography will not promise more than 1 photographer on any day.

Limitation of Liability:
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Cancellation:
The Client may cancel this contract at any time by giving written notice to The Photographer/s but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment of 60% of the total cost being due immediately.

VAT:
All prices are inclusive of VAT (where applicable at current rate)

Negatives/Digital Files:
Negatives / digital files remain the property of The Photographers.

Blinking:
Should the photographer notice that a member of the wedding party or guest has been seen to blink, the photograph will be taken again but it is impossible to guarantee to see all of them.

Parking Provisions:
It is the CLIENT'S duty to ensure parking spaces are reserved for each LMB team member as close to all venues as possible. LMB photography is not responsible for any footage not captured due to any of the team members being unable to find a parking space.

Travel:
There are no charges for consultations and visits to you or your chosen venues. We will not charge you any travel expenses for any venue less than 50 Miles from Colchester, Essex (CO2). For clients who live outside this distance travel expenses will be charged at 50p per mile. Please use the AA website to calculate the mileage.

Health & Safety:
LMB photography will act in accordance with all relevant health and safety requirements in order to provide the product(s) or service(s).

Complaints:
Any complaints should first be raised by the Client with the Photographer/s in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers to mediate but only on the basis that its decision shall be final and binding upon both parties.
