These terms and conditions apply to bookings, vouchers, competitions, photography sessions and orders placed with Hammonds Photography Studio, a trading name of Hammonds Creative Studio Limited (“we”, “us” or “our”).
By booking an appointment, purchasing or using a voucher, attending a photography session or placing an order, you agree to the relevant terms below. Nothing in these terms affects your statutory consumer rights.
1. Booking deposit
A refundable booking deposit is required to secure your appointment.
Your deposit covers attendance at your photography session and viewing appointment. Both appointments must be attended for the deposit to be refunded.
Your deposit will be refunded at your viewing appointment, subject to these terms. Alternatively, you may choose to use it towards an order.
The deposit is separate from the cost of any voucher, photography package or products purchased.
2. Changing or cancelling an appointment
At least 72 hours’ notice is required if you need to cancel or rearrange an appointment.
If fewer than 72 hours’ notice is provided, or you do not attend, your booking deposit may be retained and a new deposit will be required to make another booking.
We understand that genuine emergencies can happen and may consider exceptional circumstances at our discretion.
If an appointment is changed more than three times, we reserve the right to decline further rearrangements. Voucher expiry dates will continue to apply.
If we need to cancel an appointment, we will offer you a suitable alternative date. If one cannot be agreed, we will refund any booking deposit and payments made for services that have not been provided.
3. Late arrival
Please arrive on time for your appointment.
If you arrive late, the lost time may be deducted from your session because other customers may be booked after you.
If you arrive more than 20 minutes late, we may need to cancel or rearrange your appointment. Your booking deposit may be retained if the appointment cannot reasonably continue.
4. Vouchers and promotional offers
Unless stated otherwise, vouchers are valid for six months from their date of purchase.
Photography sessions and viewing appointments must take place within the voucher’s validity period unless we agree otherwise in writing.
Vouchers cannot be combined with another offer, voucher, prize or photography package unless expressly stated.
Vouchers cannot be exchanged for cash or used to purchase products from a previous photography session.
Purchased vouchers are subject to any applicable statutory cancellation rights. After those rights have expired, vouchers are non-refundable unless required by law.
Only one promotional voucher may be used by the same family or household within a 12-month period.
A maximum of three complimentary products may be claimed by the same family or household within a six-year period.
There is no obligation to make an additional purchase.
Complimentary products must reflect the type of voucher used. For example, a complimentary product supplied with a pet voucher must feature the pet.
The customer claiming a voucher or complimentary product must be aged 18 or over.
A voucher may become invalid if the customer does not attend an appointment and has not provided the required notice.
Promotional vouchers are not designed for groups of unrelated friends unless the offer specifically states otherwise.
The photography session has a standard value of £75 and the complimentary print has a standard value of £89, unless a different value is shown on the voucher or offer.
A complimentary promotional product may be supplied with or without the studio logo, depending on the offer and what has been agreed with the customer.
5. Family photography vouchers
All relevant general voucher terms also apply.
A family photography session normally includes at least two generations of the same family.
Family vouchers are not intended for children alone, groups of unrelated friends or pets photographed without their family.
Where reasonably possible, the immediate family included in the booking should attend the photography session.
A parent or legal guardian must attend every appointment involving a person under the age of 18.
6. Makeover, boudoir and Pin-Up vouchers
All relevant general voucher terms also apply.
Unless stated otherwise, each voucher covers one person.
Friends wishing to have individual makeover experiences must each purchase a voucher and may need to attend on separate dates.
Any complimentary image must feature the voucher holder.
Make-up and hairstyling are provided for the photography session and are not intended as a separate salon service.
Customers must tell the make-up artist about any known allergies, sensitivities, skin conditions or relevant medical concerns before products are applied.
Customers may request the removal of make-up after their session.
We will take reasonable care when selecting and applying products. Nothing in these terms excludes or limits liability where it would be unlawful to do so.
7. Pet photography sessions
All relevant general voucher terms also apply.
The pet’s owner or responsible handler must attend all appointments.
More than one pet may participate if this has been agreed with the studio before the session.
We reserve the right to stop or refuse a session if we reasonably believe an animal presents a safety or welfare risk.
Owners remain responsible for supervising and controlling their animals at all times.
Pets must be kept on a suitable lead or secured in a carrier when requested.
Owners are responsible for cleaning up after their pets and for any avoidable damage caused by an animal under their control.
Customers are responsible for ensuring that they have any insurance, permissions or legal documentation required for their animal.
8. Third-party vouchers
Vouchers purchased through another website or retailer are also subject to the terms displayed by that provider.
If you purchased the wrong voucher, please contact the third-party retailer from which it was purchased.
Refund requests relating to a third-party purchase must normally be made to the retailer that received your payment. This does not affect your statutory rights.
Complimentary products must match the voucher purchased. For example, a family voucher must feature the eligible family and a newborn voucher must feature an eligible newborn baby.
You are welcome to purchase additional products at your viewing appointment, but there is no obligation to do so.
We may offer a reasonably equivalent complimentary product if the advertised product is unavailable.
9. Competition prizes
All relevant general terms and any competition-specific rules apply.
There is no obligation to purchase additional products.
Only one competition prize may be claimed by the same family or household within a 12-month period.
We may contact winners by telephone or email to administer the prize and arrange their appointments.
Winners must provide their confirmation email or other evidence of the prize when requested.
A refundable booking deposit is required to secure an appointment.
Prizes cannot be exchanged for cash and cannot be transferred unless we agree otherwise in writing.
10. Viewing appointments and orders
Your viewing appointment forms part of your photography experience and normally takes place on the same day as your photography session unless agreed otherwise.
Products are made to your individual specifications using the images and options you select.
Please check your image choices, sizes, frames, finishes and other order details carefully before confirming your order.
Once production has started, a personalised order cannot usually be changed or cancelled unless the product is faulty, does not match the agreed order or another statutory right applies.
Where an order is placed online, by telephone or away from our studio, statutory cancellation rights may apply. Exceptions can apply to personalised or custom-made products and to services that begin at the customer’s express request.
Any applicable cancellation rights and exceptions will be explained before an eligible distance or off-premises order is completed.
If there is a problem with your order or service, please contact us promptly so that we can investigate and, where appropriate, repair, replace, repeat or otherwise resolve the issue.
We will notify you when your order is ready. Orders should be collected within six months of that notification.
Please inspect your order when it is collected or delivered and notify us promptly if you identify a fault or error.
Portraits should be kept away from direct sunlight, excessive heat and moisture.
Nothing in these terms limits your rights under the Consumer Rights Act 2015.
11. Copyright and permitted use
Unless agreed otherwise in writing, copyright in photographs created by Hammonds Creative Studio Limited remains with Hammonds Creative Studio Limited under the Copyright, Designs and Patents Act 1988.
Purchasing a print or digital image does not transfer copyright ownership.
Customers who purchase digital images are granted permission to use and reproduce those images for their personal, non-commercial purposes.
Images must not be commercially reproduced, sold, substantially altered or supplied to another business for commercial use without our written permission.
We will not use identifiable customer photographs publicly for advertising, social media, competitions or portfolio purposes unless we have an appropriate lawful basis or permission to do so.
12. Personal information and image storage
We process personal information in accordance with our Privacy Policy and applicable UK data-protection law.
Customer information may be used to administer bookings, provide photography services, fulfil orders, maintain accounting records and meet our legal obligations.
We may use appropriate service providers, including booking, payment, gallery, printing, delivery and accounting providers, where necessary to provide our services.
Photographs and customer records will be stored securely and retained only for as long as reasonably required for the purposes explained in our Privacy Policy.
Customers may contact us to ask about their personal information or request the deletion of eligible information. Some records may need to be retained for legal, accounting or contractual reasons.
Please read our full Privacy Policy for further information about how we use personal information and how to exercise your data-protection rights.
